International Consultant to support UNDP Mozambique in the elaboration of the new Country Program Document (Justice and Human Rights Program)

Background

The work of UNDP Mozambique is guided by the United Nations Development Assistance Framework 2017-2020 (UNDAF), and now renamed United Nations Sustainable Development Cooperation Framework (UNSDCF), which describes the collective vision and response of the UN system to the Government of Mozambique development priorities and its Country Program Document 2017-2020 (CPD) which outlines UNDP contribution to government results and the UNDAF theory of change.

The current UNDAF 2017-2020 and CPD 2017-2020, were extended in one-year given the various unprecedented events, such as Cyclones Idai and Kenneth as well as the presidential elections that took place in 2019, and to match the Mozambican government’s programme period, and will end in December 2021.

Following recent reforms repositioning the UN development system, the UN Sustainable Development Cooperation Framework (UNSDCF) is the most important UN planning and implementation instrument in support of 2030 Agenda in Mozambique. As a prerequisite to the development of the UNSDCF, an evaluation of the current UNDAF and a Common Country Analysis (CCA) have been undertaken by the UNCT in 2020-2021 on the basis of which, and in full consultation with national Government, the UNCT will elaborate the new UNSDCF in 2021.

Within the current UNDAF framework, UNDP is the leading agency of Outcome 8 “All people benefit from democratic and transparent governance institutions and systems that ensure peace consolidation, human rights and equitable service delivery,” and under its current CPD it supports the Government of Mozambique in the following program priorities:

  1. Sustainable and inclusive economic transformation.
  2. Resilience and natural resources management; and
  3. Good governance, peace, and social cohesion.

The Governance and Social Cohesion work is focused on democratic and transparent governance processes that promote peace and social cohesion, rule of law, justice, human rights and security and provides support to local institutions and partners, including Government institutions, non-governmental and civil society organizations, at central and decentralized levels.

UNDP CO has been supporting the justice and human rights sector through partnership with Ministry of Justice of Mozambique for almost 2 decades. Within the current program framework, UNDP has been supporting the Ministry of Justice (Supreme Court, the Attorney General’s Office, the Correctional Services, the Directorate for Human Rights, the Free Legal Aid Institute) and  National Human Rights Institutions (the Ombudsman and the National Human Rights Commission) towards improving the condition of justice services and enhancing the protection of the human rights system and institutions.

Priority areas of intervention of UNDP Mozambique partnership with the sector include:

  1. Reinforce legal aid and the provision of integrated services at the local level.
  2. Support to criminal justice reforms, with a focus on the implementation of alternatives to prison.
  3. Enhance the national human rights system and framework and the Government reporting to regional and global human rights mechanisms and body treaties.
  4. Promote the protection of the rights of victims of GBV, PLHIV/AIDS and people living in detention.
  5. Enhance the capacity of National Human Rights Institutions to monitor and protect human rights of the most vulnerable people.

The new UNDP CPD, which will be aligned with the UNSDCF and the Government of Mozambique’s priority, is to be designed in 2021, based consultations with government, civil society, private sector and other stakeholders and partners. UNDP Mozambique has recently started internally a process of formulation of the next CPD.

In the view of the above, UNDP Mozambique is recruiting an international consultant to support the Governance and Social Cohesion Unit to prepare for the elaboration of the next CDP through the development of a comprehensive program in the areas of Justice and Human Rights.

Duties and Responsibilities

OBJECTIVES OF THE CONSULTANCY

These terms or reference aim at recruiting an International Consultant to support UNDP CO Governance and Social Cohesion Unit in the elaboration of a comprehensive program in the areas of Justice and Human Rights in preparation of the development of the next UNDP CPD.

DUTIES AND RESPONSIBILITIES

Under the supervision of the Head of the Governance and Social Cohesion Unit, and in direct consultation with the Justice and Human Rights Program’s Team, the individual consultant will perform the following duties and responsibilities:

  • Conduct a desk review of relevant documentation (to be shared by UNDP Mozambique). The desk review will include the revision and analysis of the UNDAF 2017-2020, UNDP current CPD 2017-2020, UNDP current strategic engagement, programs, and results in the areas of Justice and Human Rights, UNDP Governance Portfolio, the UNCCA, the Government Quinquennial Plan 2020-2024, as well as any relevant strategic document and report.
  • Mapping and analysis of program gaps (programmatic, thematic, geographical, and financial) and strategic opportunities for UNDP Mozambique intervention in the areas of Justice and Human Rights.
  • Facilitate meetings and consultations with UNDP Senior Management and Program Team, UN Agencies and National Institutions.
  • Design of a program proposal for UNDP Mozambique in the areas of Justice and Human Rights which will set UNDP priorities and strategic opportunities in preparation of the new CPD.
  • The program proposal shall be aligned with the required standards for the elaboration of a UNDP CPD. This shall include:
    • Program rationale, which shall include:
      1. Strategic analysis of UNDP current engagement and gaps in the areas of Justice and Human Rights, identifying current gaps, results and lessons learnt.
    • Program priorities and partnerships:
      1. Mapping of strategic priorities for programming in the areas of Justice and Human Rights. (programmatic, thematic, geographical and in terms of beneficiaries)
      2. Strategic Partnership with Government Institutions and UN Agencies.
      3. Design a Theory of Change which will inform the preparation of the next UNDP CDP.
      4. Risk analysis, outlining contextual and programmatic risks as well as flexible mitigation measures to ensure program flexibility to emerging challenges which facilitate program and financial shuffling and re-formulation towards the proposed outcomes.
    • Results and resource framework (RRF)
      1. Indicative outcomes and outputs and resources required for implementation.

PAYMENT SCHEDULE:

The payment schedule is defined in section 4 of the terms of reference and payment shall be made upon submission of deliverables and approval of the certification of services by the Head of the Governance and Social Cohesion Unit and approval.

  3. Brief description of why the applicant considers her/himself as the most suitable for the assignment
  4. Financial Proposal – The UNDP requires applicants to submit a financial proposal which clearly indicates the total lump sum amount which the successful candidate wishes to be paid for the duration of the contract, which includes all the costs foreseen for the completion of work, and supported by a breakdown of costs. that indicates the all-inclusive fixed total lump-sum contract price.

Required Skills and Experience

Education:

  • Master’s degree in Law, Human Rights, or any other relevant field.

 

Experience:

  • A minimum of 12 years of experience in the areas of Justice, Rule of Law and Human Rights, working with international organizations (including the UN System) and Government institutions.
  • Previous experience in program development, drafting of a UNDAF/UNSCDF or UNDP CPD or UN Agency country program document.
  • Experience in developing problem analysis and theory of change framework on development issues, particularly issues related to UNDP practice areas: Democratic Governance, Justice, Human Rights, Rule of Law, Security, Peace and Social Cohesion.
  • Experience on the Mozambique system and current context is an asset

 

Language:

  • The minimum language requirement is full fluency in English. Knowledge of Portuguese would be an asset.
