National Legal Expert on Corruption Prevention in Environment Protection

In order to explore areas for which there are indications that are highly vulnerable to corruption within the protection of the environment, in 2020 the Mission commissioned an expert analysis on the state-of-affairs with the corruption in environment. Some of the conclusions indicated a need to assess laws and bylaws in the area of environment from the aspect of corruption vulnerability, to substantially strengthen capacities of the responsible authorities at central and local level and to improve cooperation of the citizens’ associations with the media.

In order to conduct an anticorruption assessment of the legislation in the area of environment protection, the Mission is looking to engage a National Legal Expert on Corruption Prevention in Environment Protection. The National Legal Expert will analyse the laws and by-laws in the area of environment protection in line with the Methodology for anti-corruption assessment (adopted by the SCPC in November 2020) and produce a report detecting concrete provisions in the national legislation that contain corruption risks and recommending legislative amendments to reduce existing or possible corruption risks.

The Expert will be tasked to analyse laws and by-laws in the area of environment protection and produce a report detecting concrete provisions. More specifically:

1. Cooperate with the Mission, State Commission for Prevention of Corruption and relevant ministries in the planning and implementation of the anti-corruption assessment of the legislation on environment protection;
2. Present research methodology for the anti-corruption assessment of the legislation on environment protection;
3. Analyse national legislation regulating environment protection, including but not limited to Law on Environment, Law on Nature Protection, Law on Ambient Air Quality, Law on Waste Management, Law on Waters, Law on Forests, etc.
4. Analyse national legislation on corruption prevention and conflict of interest, including but not limited to the Law on Prevention of Corruption, Law on Criminal Procedure, Criminal Code, Law on Whistle-blowers’ Protection, Methodology for anti-corruption assessment of the legislation, etc.
5. Propose draft concept for the final report of the anti-corruption assessment of the legislation on environment protection;
6. Conduct interviews with relevant stakeholders in the country, based on the proposed list of counterparts (Ministries’ representatives, local self-government units, civil society organizations, etc) approved by the Mission and the SCPC;
7. Submit draft concept for the analytical report on the anti-corruption assessment of the legislation on environment protection;
8. Deliver the draft report to the OSCE Mission to Skopje and SCPC;
9. Present in an online event for the relevant stakeholders in North Macedonia the draft report approved by the OSCE Mission to Skopje and SCPC;
10. Submit the final report to the OSCE Mission to Skopje;
11. Any additional consultations regarding the produced report.

• Citizenship of or permanent residence in the Republic of North Macedonia;
• Second-level university degree in law, public administration, economy or other field of social sciences relevant to the area of engagement;
• At least 6 years of professional experience in the field of corruption prevention and repression, environment protection, democratic governance, criminal law;
• At least 6 years of professional experience in conducting analytical works in the area of anti-corruption and environment protection;
• At least 5 years of experience in providing consultancy services in the area of anti-corruption and environment protection;
• Excellent analytical, communication, presentation, organizational and writing skills;
• Knowledge of English language;
• Computer advanced;
• Gender awareness and sensitivity, and an ability to integrate a gender perspective into tasks and responsibilities.

For the services provided, the National Legal Expert will be remunerated with a lump sum of EUR 2,500.00, payable in 2 instalments, upon successful delivery of the services as foreseen in the Terms of Reference.

The foreseen period of engagement is from June to October 2021, with estimated up to 40 working days of engagement.
