Provide technical support to MoSA to identify amendments needed for Law 422/2002 on The Protection of Children in Conflict with the Law and At Risk, and to subsequently undertake the legislative drafting of the recommended law.

How can you make a difference?
Scope of Work:

Efforts are currently underway to amend Law 422/2002 for the Protection of Children in Conflict with the Law or at Risk. These efforts are led by the Parliamentary Committee on Woman and Child, with the participation of representatives from the Ministries of Justice (MoJ), Social Affairs (MoSA), Labour (MoL), and UNICEF (hereafter referred to as the ‘Drafting Group’).

MoSA will be proposing to the Parliamentary Committee a comprehensive amended law, and the Consultant is expected to provide MoSA with the technical support necessary to identify the amendments needed; and subsequently to undertake the legislative drafting of the recommended amendments into a comprehensive law.

Throughout the implementation process for this project, the Consultant shall also be working in close collaboration with MoSA, through representatives nominated by the MoSA DG to support the process, and with UNICEF justice specialists.

To identify the amendments needed for Law 422/2002 and draft the recommended law, the Consultant shall undertake desk reviews and consultations with relevant stakeholders. More specifically, he/she is expected to:

• Undertake a robust analysis of the existing law, in terms of actual legal provisions and implementation; and identify gaps, inconsistencies, and shortfalls.
• Undertake an analysis of linkages/redundancies with all related national laws (e.g. Law 293, penal code…).
• Undertake a comparative analysis of relevant MENA region laws to provide an overview of current practices in the region, and to shed light on recommended provisions.
• Identify promising practices and integrate them into the recommended amendments (with emphasis on experiences from the Arab region) and ensure alignment with international principles.
• Undertake focused and expansive consultations with relevant stakeholders, governmental and non-governmental, to ensure that all relevant input is identified and integrated into the recommended amendments. Consultations shall take into consideration Covid-19 safety measures. As such, they shall consist of key-informant interviews, either virtually or face-to-face, or bi-lateral meetings with small numbers of participants.
• When the proposed amendments are agreed to by MoSA, the Consultant shall draft the recommended legal text for submission by MoSA to the Parliamentary Committee.
• Revised the draft recommended legal text submitted by MoSA to the Parliamentary Committee, while integrating the comments/feedback provided by the latter.

The stakeholders to be consulted to inform the identification of the needed amendments, include mainly, but are not limited to:
1- Representatives from the ministries of Social Affairs, Justice, Labour, Education and Higher Education
2- Representatives from mandated non-governmental organizations, including Union pour la protection de l’enfance au Liban, Himaya, Mouvement Social, Fondation Afif Ousseiran, Enfants de la Guerre
3- Representatives from other non-governmental organizations relevant to related national laws (e.g. Kafa and Abaad in relation to Law 293), including Bar Association.
4- Representatives from UN agencies, including UNODC, UNHCR and UNICEF
5- Children, in conflict with the law or at risk, and their caregivers.

To qualify as an advocate for every child you will have:

Bashelor degree in Law, preference shall be given to candidates with a Masters degree.
Experience in legislative drafting, and processes for legislative amendments.
Strong knowledge of justice proceedings for children in Lebanon
Strong knowledge of the global conceptual framework surrounding child justice
Five to 10 years of experience working on matters related directly to justice in Lebanon
Ability to work independently and as part of a team
Fluency in Arabic, English or French is a strong asset.

المهام/نطاق العمل:

سيقوم الاستشاري بتقديم دعم فني إلى وزارة الشؤون الاجتماعية لتحديد التعديلات اللازمة على القانون 422/ 2020 حول حماية الأطفال المخالفين للقانون والمعرضين للخطر، ومن بعدها سيبدأ بعملية الصياغة التشريعية للقانون الموصى به.

الجهود جارية لتعديل القانون 422/ 2020 حول حماية الأطفال المخالفين للقانون أو المعرضين للخطر. وتتولى اللجنة البرلمانية المعنية بالمرأة والطفل عملية إدارة هذه الجهود، بمشاركة ممثلين عن وزارة العدل، ووزارة الشؤون الاجتماعية، ووزارة العمل واليونيسيف (ويُشار إليهم في هذه الوثيقة باسم “المجموعة المعنية بالصياغة”). ستقوم وزارة الشؤون الاجتماعية باقتراح قانونًا معدلًا شاملاً للجنة البرلمانية، ومن المُتوقع أن يقوم الاستشاري بتقديم الدعم الفني اللازم لوزارة الشؤون الاجتماعية لتحديد التعديلات المطلوبة، ومن ثم القيام بالصياغة التشريعية للتعديلات المقترحة في قانون شامل.

خلال تنفيذ هذا المشروع، سيعمل الاستشاري أيضًا بالتعاون الوثيق مع وزارة الشؤون الاجتماعية، من خلال ممثلين يتم ترشيحهم من قبل المديرية العامة لوزارة الشؤون الاجتماعية لتوفير الدعم للعملية بالإضافة إلى أشخاص متخصصين في حماية الأطفال في اليونيسف.

لتحديد التعديلات اللازمة للقانون 422/ 2020 وصياغة القانون الموصى به، يجب أن يقوم الاستشاري بمراجعات مكتبية والتشاور مع الجهات المعنية. وبشكل أكثر تحديدًا عليه القيام بما يلي:

              تحليل القانون الحالي بشكل دقيق، من حيث الأحكام القانونية وطريقة تطبيقها، بالإضافة الى تحديد الثغرات والتناقضات وأوجه القصور.

              تحليل الروابط مع القوانين الوطنية الأخرى ذات الصلة والمواد التي تتكرر (على سبيل المثال القانون 293 ، قانون العقوبات  

              مقارنة القوانين ذات الصلة في منطقة الشرق الأوسط وشمال إفريقيا وتحليلها، لتقديم لمحة عامة عن الممارسات القائمة في المنطقة، وتسليط الضوء على الأحكام الموصى بها

              تحديد الممارسات الواعدة ودمجها في التعديلات الموصى بها (مع التركيز على تجارب البلاد العربية) وضمان توافقها مع المبادئ الدولية. إجراء مشاورات مركّزة وموسّعة مع الجهات المعنية، والجهات الحكومية وغير الحكومية، للتأكد أن جميع المدخلات ذات الصلة تم توثيقها ودمجها في التعديلات الموصى بها. يجب الالتزام بتدابير السلامة الخاصة بفيروس كوفيد-19 عند إجراء التشاورات والاجتماعات، وبالتالي يجب أن تتم المقابلات مع المخبرين الرئيسيين عن بعد أو وجهاً لوجه، أو  أن تُقام اجتماعات ثنائية مع عدد صغير من المشاركين        عند موافقة وزارة الشؤون الاجتماعية على التعديلات المقترحة، يقوم الاستشاري بصياغة النص القانوني الموصى به وتقوم وزارة الشؤون الاجتماعية بدورها بتقديمه إلى اللجنة البرلمانية

              مراجعة مسودة النص القانوني الموصى به المقدم من وزارة الشؤون الاجتماعية إلى اللجنة البرلمانية، ودمج التعليقات / الملاحظات المقدمة من اللجنة
